by roufnek » Mon Dec 06, 2010 07:05 am

My attorney sent a demand letter on 11-02 and gave the insurance until the 11-19 to respond....the adjuster called and requested additional to "wrap up the case" as he said. I was rear ended by an 18 wheeler and it was discovered that their driver was 100% liable ....so do u think insurance company requesting more time settle since they know their at fault...

They may be trying to establish whether the driver was negligent or not. No negligence, no liability. But, when liability is clear, the claim must be paid promptly.

It wasn't by any chance OOIDA? IMHO they are terribly slow and try to drag their feet and pay only the absolute minimum they can get away with -- after forcing you to sign a settlement agreement that attempts to absolve them of even supplemental claims!

I do that all of the time. Two weeks to get to an injury demand is not a lot of time. It's not like adjusters sit around and wait on one claim. Many adjuster may have 100-200 active claims at a time. They may be out of the office for a few days. It then takes several hours to review a large demand and this is not easy. The phone rings, new claims come in, etc. I've reviewed demands the same day they come in.. I've gone through them by the next day. But sometimes it just can't be done in 10 days... especially this time of year.
