My baby is due in 5 weeks and my company has just switched our health insurance. I cannot come up with another $1000 plus 20% before 5 weeks so I qualified for Sooner Care. Seems how I just signed up for the new insurance last week, do I have the right to refuse it at this time? My company says I can't.

Your post is a bit confusing. When you are covered under an employer-sponsored plan, if the employer changes from Plan A to Plan B, you are not supposed to suffer any "harm" with regard to coverage. The principle is called "EXTENSION OF BENEFITS" -- if on claim at the time of change, and Company B will not take over the claim, then Company A must continue the claim until it ends or the benefit is exhausted. Also, you must generally be given credit for any deductible already satisfied under Policy A. (However, if your deductible is a "calendar year" deductible, you would likely have a new deductible to satisfy come January 1, 2011 anyway.)

So we need a bit more information to be able to understand your situation. You can PM or email me with personal details if you don't want to post them here online. Click on the links below.
