and the insurance company the other guys- they want to total the car out but they said for us to keep it we have to make all the repairs and would send someone out to make sure we did or else they are taking the car is this a law now?

Not by a long shot! They have some choices... they can issue what they owe you, less the salvage value and report the vehicle being a total loss to the state or you can give them the vehicle. No one has a right to take away your personal property without your permission. Also, the can't withhold what they _legally owe you_ if you don't surrender your personal property. If an adjuster is telling you this simply speak to that person's supervisor as the adjuster _obviously_ does not have a clue how to do their job. Anyone with a little knowledge on who to adjust claims will know that they cannot withhold payment unless they take your personal property.
If you have a lien on the vehicle then the situation is a little different as your lien holder then has a say so in how it's handled.
