I was on my way to see my son in nc with my 6yr daughter i lost control of my jeep and we flipped over in a pond, I got out freaking out to get my daughter two men helped me kicked the window out so i could crawl in the water to try to find the release seatbelt it was snowing and she was fine except cold feet and me frozen brusied and cut but we are alive the next day the cop called and said i could get my stuff out of my jeep but i did not have my purse i did not know if it was in the pond we went to see the tow company and he said i could not touch my car without identification but my son i'm in army reserves unemployed had his id and still he said no and wanted 550 right then plus storage fees we waited two hours for the cop to get there and i filled out report and the cop left and he told us he would just ask for title and it is totaled and pay him 450 by the next day i only had 242 all my money and i live in virginia i only had liability 89 jeep with over 180,000 miles on it i have rent due on 5 of jan, no car to get us back home and only 242. plus 340 that has not arrived in my account from unemployment he has threatened a warrant, and he said he would take it to the next level now he wants 200 by tomorrow and title what can i do i'm staying with my son and his dad but it is my responsibilty to pay not my family or my ex he is self employed does not get hourly pay can you help me.

Did the cop actually offer you a statement demanding $450? Or was it just a verbal demand? Have you sought any explanation for the said amount?

andhe has threatened a warrant, and he said he would take it to the next level now he wants 200 by tomorrow and title what can i do
DON'T GIVE THE TOW YARD A PENNY!!
If you don't have collision insurance coverage, and your vehicle is totalled, fine, you can give the tow yard the title and walk away. The tow yard cannot "demand" money unless you try to take the vehicle away, and they cannot issue a "warrant" for your arrest -- only a judge can do that, and there's nothing here to justify that action.
You are simply being victimized as a woman who doesn't know what her legal rights or responsibilities are.
Tell the tow yard operator to pound sand and that you'll send him the title when you get around to it.
Then try to have as merry a Christmas as possible under the circumstances, and believe that 2011 will be a better year for you and your daughter.
When you get home, sign and mail the title to the tow yard. You'll never hear another word about it. They'll junk the vehicle for money -- that's their compensation.

Listen to Max! You're surely being victimized over here. That's one reason we should always be aware of our driving rights besides knowing the state norms. The tow yard people don't deserve to get money from you besides the title.

I gave him 140 a money order and my title and he gave me a money order and said i owe him 360 by the 10 of jan sucks too bc i'm unemployed the money i gave him i should have gave to the ones that saved me i saw them after i left the tow guys house i was told he can take me to court for the money and i would incur more debt if i go to court i researched called a lawyer the only thing he said was he cant take me to court so do i just go on my way not worry about him or can he still take me to court i cant afford anything else i have to save to pay rent is 475 i get paid this week 340 unemployement check but have to save it and combine it with next week to pay rent just truly in a bind and now no car but thank you all for your commemnts just wish i knew now cause i could have used that money but i felt he had a job and he needs to get paid too but i thought he was rude and could have waited until i got in a better situation and yes i felt harrassed
