insurance agent made a big mistake, what can i do?

My agent set me and my husband up under 2 different companies.
we were told it was ok cause we are both with the same agent.
well he totalled my car and my company says, my agent made a mistake and they are trying to fix it.
as of right now i have no car and they are not covering the accident till futher investigation of my agents mistake.
Not sure if i should drop company names but the company is a top company and its my first claim with them.
i got a line from the adjuster that WE have to be rated under the same policy and my agent said no.
so IF they tell me "sorry the accident is not covered" what do i do?

she did say it should be ok. "should does buy a new car"

My first question would be.... what was th mistake? I think you might be stating that the application you and/or your husband signed required you to list everyone in the household and that this was not done. Are they stating that there was Material Misrepresentation? Have they sent you a Reservations of Rights letter outlining what the issue is?

Keep in mind that your agents actions may be binding on the insurance company. If not, then your agent would still be responsible for his/her mistake. That is why your agent has Errors and Omissions coverage.

my agent was required by her underwritters to ad my husband. She didnt think that to be true.

she figured if he had one company and i had another on different vehicles it was ok. She didnt list him on my policy as a driver living in the household.

i hope i can say this name. Farmers requires all house hold drivers to be "rated" on a poicy and the figured if he was 'rated on bristol" it was ok.

the claims person wasnt happy and she is trying to add him now.
will she be able to make the corrections so the accident will be covered? all i want is m totalled car to be paid off and i get the diference as well as the other car fixed.
