what types of letters do insurance companies send out certified mail? Denials?

Do they all operate differently.....I have had one ins. company pay an auto damage claim and mail the check regular mail. I have had a denial sent regular mail as well. So, this new insurance company (new claim) has sent me something certified and I am wondering if it most likely the denial?

What recent interaction have you had with this company and is it an auto insurance company?

I usually don't send payments or denials certified mail. I always send Reservation of Rights letters both certified and regular mail (the same letter both ways). Basically, anything that _I_ may need to show has been received by the person.

That is what my husband thought (as he works in insurance). We will pick up the letter tom. but I was taken back when I saw the post office slip on the door. I was expecting a denial letter.

To give you a quick summary....I hit a pot hole in a construction zone back in April. It caused close to 1000.00 worth of damage. The hole was filled with water from a broken water line under the road. The county had repaired this hole and water line 5 days prior to my hitting it. However, the day after they repaired it the construction crews arrived and moved the barricades surrounding the hole and milled the road. This milling, weight of the equipment, caused the pot hole to reopen and the water line to break again. I have this in writing. I also have a recorded conversation where a county worker states the above information and that he saw the construction crews working. He also stated that the road should have been blocked off when I hit it. I have a signed statement from the county worker as well (the same one on the recorded call). I have done months of research - collecting records, etc. I have 5 county witnesses, in writing, state they saw the construction crews working. I have two independent written statements testifying the pot hole was there for several days, unprotected, and with crews working all around it.

The county has denied my claim. I submitted this claim to the construction companies insurance and I spoke to the second manager last week. They are trying to deny my claim. I told them I will be suing them (which I am preparing now). She said she has to clear up one thing with her agent and if something changes she will contact me. Now today I get this notice that I have a certified letter from them. I guess I was just expecting a denial letter in the regular mail like I got with the county. The construction company also could not provide their insurance company with proof where they were working during this time. They are just telling their insurance company "they weren't there" and they are taking their word.

I have supplied more than enough info to both the county and the construction companies insurance to prove negligence. I have absolutely no idea how they are still denying my claim.

What does the Reservation of Rights letter mean?
Mainly, why would I be getting now after several months and after they already told me they were going to deny it?

I also forgot to point out that the construction company's insurance tried to call the county and accept partial blame and pay a portion of the claim so that they could come together as a whole and pay the claim. So, that is admitting guilt, at least partial guilt. However, the county has dug their feet in the ground and will not admit any liability. The construction company has not offered to pay half without the county's contribution. I do not understand that.

I have been advised to sue the county and the construction company. Do you have any advice on this? Do I need to list all the subcontractors in the suit as well or just the main contractor?

I have been told that by filing suit they will most likely settle. Is this what you have seen as well?
