My car was hit my a driver that failed to yield the right of way. She did not stop at the scene, an had no DL. She was taken to jail. Her insurance company accepted responsibility. How every they are not able to get me into a rental. I am not able to get one because I am only 20 years old.
. However the rental company will only rent a car to me if the insurance company pays them directly I am missing work because my car it totaled from the accident, an the insurance company said they will no pay out for my lost wages

What her insurance co. can meet will largely depend on her policy benefits. See, someone has to pay the rental company, otherwise why will they rent a car to you!

Your choices are limited to renting your own vehicle and presenting the third party insurer with your expenses for loss of use of your vehicle, or taking a bus, taxi, paying a friend for your commutes and errands. They are liable for your loss of use until they present you with an offer for settlement.
As a third party claimant, you can't make the insurer of the negligent party do anything, but you can make them pay for all the damages and expenses you incurred as a result of the negligence of their insured within what is reasonable and necessary in the eyes of the law. You may have to hire an attorney or go to small claims court to file suit to collect the underpayment offered by the insurer.
