Medical Follow up for Pre-Existing Condition

My wife and I was rear-ended in an auto accident that was not our fault. I started having back pains and mmy doctor said it might have been a muscle spasm. When the pain did not go away I had a Lumbar x-Ray which showed that I have extensive arthrits which was a pre-existing condition I didn't know about that was probably aggravated by the inflammation due to the accident. Should the at-fault insurance company, in determing settlement for personal injury and pain and suffering only consider the costs up to and including the x-ray, and should I use my regular medical insurance to help pay for follow-up medical costs to treat the arthrithis?

I do empathize with you. This is why we often suggest you not to accept a final settlement till you're sure of your overall treatment expenses. More often, we see people complaining that they can't do anything after accepting a full-n-final settlement offer. You should be careful about thoroughly getting yourself diagnosed and certified by a medical practitioner. Let go by a certain span of time till you've almost recovered, and then go for a settlement.
