car insurance company dispute...

I feel I was strongly misrepresented by my insurance company and they still simply not doing what I have paid them to do as a client. I was in an accident with a person, who subsequently filed a claim against me with my insurance company. The claim was never properly verified by my insurance, and is the reason for which I cannot collect remains of my deductible even though my car has been declared a total loss in the aftermath of the accident. I am thinking who should i sue now? The person who filed a claim against me, even it was obvious who was at fault driver (there must have been a police report that my insurance could have easily obtain and verify.) Instead, they did nothing to properly represent me and still trying to rip me off! Is there anything I can do to simply seek justice?

If I understand it correctly, your carrier paid your claim and you feel that they should recover your deductible but they are not. There is no incentive for them not to collect if they think they can... as then they would be out their money as well. But they are under no obligation to seek recovery. If they are not going to, you are free to collect your deducible back yourself. You may want to write a letter to your insurance company putting them on notice that you understand that they won't be pursuing recovery so anything you collect is your money.
