can I sue them for not fixing my car? I recently renew my insurance and 4 days later my car was in a accident. The insurance company said they will not fix it because I did not have a onsite police report. In chicago, if you are not hurt and u can still drive your car, they tell you to come to the police station. Now i have a car that is damage and my insurance is paid up, but they will not fix it because I do not have a on site report. what should i do?

I doubt that was the reason for the denial... or actually I'm betting that they think the loss occurred while you were uninsured. Big difference for denying a claim for no police report and denying a claim that happened outside of the policy period. Can you sue? Sure... for breaking their agreement as per the contract. They will need to show some indication that the loss occurred outside of the policy period or that the terms of the policy were not followed.
