I am on State disability in CA and will not be able to return to work until July 3rd....I may be laid off as my boss does not want to hold the job open....Can I then collect unemployment if the benefits from disability and for unemployment are pulled from the same benefit quarters...

You can be disabled and you can be unemployed -- many persons are. But you cannot collect BOTH disability benefits and unemployment insurance benefits at the same time.

To collect unemployment benefits, you must be able to work and actively seeking work. To be disabled means you cannot work. One or the other only.

I probably didn't clarify sufficiently...I will be physically able to return to work per my doctor on July 3rd, 2011.however, my boss ( it is just he and I ) will not hold the position open ...

Since I then will be unemployed and ready to work can I collect unemployment despite the fact that I have been paid disability from the same benefit period?

It seems that I would be penalized for my illness and have no job and would be unemployed.

Unemployment insurance benefits are not connected in any way to state disability benefits. Your unemployment benefit is based on your earned (covered) wages in the defined period prior to applying for UI. Any amounts received from SDI are not considered earned income and are not included in the calculation of your base wage for the benefit period, and the effect may be a reduction in your UI benefit.

You will have a 7 day elimination period from the time you apply for UI benefits until your benefit begins.
