Hello,
My fiancé was in an accident a few years back in California and his insurance company reported to the California dmv that he was not insured. We recently moved to Washington and got pulled over to find that his lisence has been suspended. He sent in the paper work proving he was insured and got his suspension lifted but is still facing criminal charges and has a bench warrant out for his arrest because he arrived late to his court date. (due to work conflictions) Do we have a case to sue his insurance company?

If they were incorrect, possibly. But I'm betting that there was something, such as a short lapse, change in carriers, something that lead to the notification. Then there was the state sending letters out informing of the situation. Then the letters informing him that his license was suspended. Then him missing his court date. It's not like the notification from the insurance company was the only thing that got him into this situation.

If your husband showed up in court, even if late, the bench warrant would either (1) be cancelled on the spot or (2) would have resulted in his immediate arrest and placement in custody. The court would not allow a person to leave the premises without either posting bail or paying the fine.
