what should i do?

July 2009 i was given two citations for failing to yield the right of way and driving with an expired license after causing a t-boned accident. The guy riding the motorcycle was taken by ambulance to the hospital seriously injured, broken wrist, leg contusions, back pain and scars. I only carried the minimum state of georgia limits of 25000 dollars. Today i was served a letter stating i am being sued for the accident. Why would gieco lie and say they had already settled and had not?

You'd need to call GEICO and ask them. You certainly need to forward that paperwork to them asap.

I called gieco and they said i was misinformed and that they thought to motorcycle rider had pre existing injuries and he would not sign their medical release for a prior injury. Does he have to prove anything to them since he is not insured with gieco and what if he has no prior injuries will they settle?

Before a carrier will issue a payment on an injury claim they will require that the person sign a release. The release means that the person can no longer purse the claim and that it is done. If a carrier suspects a prior injury then they might ask for an authorization from the person to obtain medical records. The person does not need to allow this. But the carrier does not need to make an offer then either.. or it could be an offer as if there were prior injuries. If the person does not like it, they can file suit. At which time the carrier will be entitled to those medical records.

Id recommend sending a letter to GEICO and asking them to offer your policy limits to settle the claim. Send it certified mail. That way, if the other person is awarded an amount higher then you limits, you'd have a better Bad Faith claim againt GEICO. That is, if the claim is not settled... which it probably will be prior to a verdict.

Seems to me that you may want to consult with an attorney, gieco has lied to you once and you may need some legal advise outside of gieco.

After almost 2yrs geico should have offered your $25000 policy limit long ago and moved on. Now they will certainly pay alot more than your limits to settle this one. With all the injuries the motorcycle rider received and if he has a spouse or any job loss his lawyer will surely what to go to trial if he does not get what he wants. Geico will settle, so make sure you protect you.

I also suggest that talk this with a lawyer. Lewis right. The gieco lied to you so seek for a professional help to solve this problem.
