You need to let your carrier handle the claim. They will make every attempt to settle for your policy limits. If the other person has under insured motorist bodily injury coverage then this will be easy. Your carrier won't pay a dime until there is a settlement or a judgement. If the other party won't accept your limits and file suit, your carrier will provide you with a defense (an attorney). If your carrier cannot settle and suit is filed your carrier will provide you an attorney but you can also hire one yourself. Expect to pay a few thousand dollars out of your pocket for this. If you don't have assets, I doubt you can afford to hire an attorney yourself.

Try to talk with your insurance company about your problem.Maybe they can help you financially and can get you a lawyer. Also try to be more careful next time. Observe road safety tips.
