My insurance agents kept pemium and all my payments and put my insurance into elapseing status with the company I had to change companies and the company that stole my money still has it.Will I need to sue to get it back? Or should I continue calling everyday .they tell me wait and they will return it.i have notified the georgia commissioner.that office says they are looking into it.
It is insurance on 2 semi trucks .it has been a real night mare.

Will you need to sue? No one knows but the insurance company and only you can make the decision. I'm guessing it's not been very long ago that you filed a complaint with the Dept of Ins? Was this an independent agent or a employee of the insurance company?

I'd right a letter to the agent and insurance company and give them xx number of days to return the premium or let them know you will file suit against both of them.

It has been about a month. It was a independent agent in Tenn. and I am in Ga.I appreciate your advice and I will write them right now.I have been calling them almost every day & I hear a different lie every time. Thanks again.

You should contact the local county district attorney where the insurance transaction took place about the process to prosecute the agent for theft. It will probably require that you make a police/sheriff's department crime report to get the ball rolling. What has occurred is probably a felony level crime, based on the amount of money involved.
