Liability for teenager

My son is 16, soon to be 17. His father is the custodial parent. We want to buy our son a car together, but his father said it has to go in his name because he is the custodial parent and would be held liable should our son have an accident. If the car and insurance is in my name, wouldn't I be the liable party?
