I was injured when my car was rear-ended while I was waiting at a traffic light. I filled out the No fault Disability Claim. I have since been unable to work and I attend Rehabilitation Therapy 4x's a week. I have had two surgical procedures. Today, I received a check in the mail from My Personal Health Coverage Plan to pay the two Doctors the balance of the surgical procedures. Why isn't the other driver's insurance company paying for this? How do I know that they are not receiving double payment?

The other person's carrier does not pay bills as they come in, like health, Medical Payment or PIP coverage. Their payment is a 1 time settlement. They will require that you sign a release before they will issue any payment so you will know when they issue a payment. You will need to agree to a settlement amount so you will ultimately need to have this discussion. Your health carrier is probably entitled to be paid back (but they don't always ask) so the settlement amount should consider this.
My first recommendation is to see if the other carrier will tell you what their limits are and/or if, based on your medical treatment, if they think their insured's limits will be an issue.

Yes, before you sign a release, you'll need to have a discussion with them. Make sure that you get all your doubts clarified during the course of your discussion.
