My sister was in a car accident the other day and the other person admitted fault at the scene and called his insurance. She had her car looked at by the other persons insurance and they said they where just waiting for a statement from the guy who hit her car and then would pay for everything, including a rental car while the car was being fixed. My sisters insurance called up the other guys insurance and claimed the accident was 50/50 without even looking at her car so she is going to be stuck paying up her deductible and the accident was not even her fault. Is her insurance company legally allowed to do that?

why did she even get her own insurance involved?? if she was not at fault the at fault insurer will pay and she will have no deductible. if she bought insurance from an agent instead of FLO or a Lizard they would have told her not to claim it on her own policy.
