Can an employer imediately terminate health benefits of 7yr

I was diagnosed with ms about 3yrs ago and was recently terminated with no warning. My health benefits were immediatly terminated the same day. I had to call to try to get in to see all my doctors within hours. I live in state of California.

WHAT DO YOU DO AND WHO DO YOU WORK FOR? BOTTOM LINE ALL EMPLOYERS THESE DAYS ARE SMELLY AS POND SCUM THEY WILL SPEND A DOLLAR TO SAVE A NICKLE.WOULD LIKE TO NO MORE INFO....DO YOU BELONG TO A UNION? PLEASE I WANT TO HERE YOR STORY,IAM IN WASHINGTON, GOODLUCK......

Well, it's truly unfortunate but it seems you'll need to go through your policy papers if any. Go through the clause that depicts the causes of policy cancellation.

This is not permitted under California law. If your health insurance coverage was in place for more than 24 months it is INCONTESTABLE and the only reason your coverage can be terminated is for non payment of premium.

The applicable section of the CA Insurance Code is:

10384.17. (c) Notwithstanding subdivision (a) of Section 10273.4 or any other provision of law, after 24 months following the issuance of a health insurance policy, a health insurer shall not rescind the policy for any reason, and shall not cancel the policy, limit any of the provisions of the policy, or raise premiums on the policy due to any omissions, misrepresentations, or inaccuracies in the application form, whether willful or not. Nothing in this subdivision shall be construed to alter existing law that otherwise applies to a health insurer within the first 24 months following the issuance of a health insurance policy.



If this applies to your situation, file a complaint with the CA Dept of Insurance immediately.
