But if you are questioning whether or not a person can be a beneficiary of a life insurance policy after being divorced, in California the answer is yes. Anyone or anything can be the beneficiary of a life insurance policy. No one other than the policyowner has the right to change the beneficiary. Anyone can challenge the beneficiary, but the burden of proof is on the person who brings the challenge to show that the policyowner was coerced or compelled to name someone or something against his/her wishes.

In about a dozen or so states, a divorce automatically takes a spouse off the policy as the beneficiary. But even that does not prevent the policyowner from renaming that same person as the new beneficiary. They just have to file the paperwork with the insurance company.
