Statute of limitaion expired on a claim, however, the insurance offered a settlement to the injured party's attorney before the statute of limitation expired. The injured party's attorney wanted a compromise because medical care to his patient is owed to the government who provided the care. Can the insurance company withdraw their offer or stop negotiation even though I await response from my higher headquarters on the request for a compromise?

Yes they can. If the person was represented by an attorney when the Statute expired then the insurance company is probably off the hook for the claim. However, the injured person has a _very_ good (slam dunk) case against their attorney.
