can you explain please

I am confused about insurance settlements.I had about 5,780 dollars in medical bills.I had some spinal and soft tissue injury.I had medical treatment but had to stop early because my tags expired and so did my insurance.After what happened to us I cant even stand the thought of driving with no insurance.I know it's not the insurance companies problem that I couldn't afford to get better.I'm sure their not complaining that I saved them money either. About my accident,without boring you with a lot of details the woman got out after turning in front of us and us hitting her asking if we were ok and saying she's so sorry and she knows its her fault.Some other cars skid on each side of us to avoid hitting her and we were the unlucky ones with nowhere to go and so we hit her after skidding 70 feet.It was determined by the accident report that we were not speeding but were a little under the speed limit.The other driver told the police and also accepted fault with her own insurance and she was given a ticket by the state police. After sitting in a hotel room for 2 days her insurance (Allstate) got us a rental so we could get 10hrs home to our other 2 kids. My question is how will the offer come?Will the special damages be in a separate offer from our pain and suffering offer?Or will I need to keep the total in mind in deciding if their offer is fair?How much should I consider fair for pain and suffering?I don't think they can EVER pay for the stress and hardship this has caused for my family but I also feel like I should be reasonably compensated.

No... a settlement is agreed to for the entire injury claim. Nothing is paid by the other carrier for the injury claim until 1 dollar amount is arrived at for the settlement.

How much should I consider fair for pain and suffering?


Its based on a number of factors such as the extent of the injury, the amount of treatment, the geographical area where the accident happened, etc.

Thanks for the reply.Yes,after reading it again and considering the fact that not everyone knows my situation I can see where it hurt your head. So I need to add my bills up and make sure the offer covers all of them? Plus hopefully get enough to get another vehicle to drive. (And no I am not greedy enough to think it will be brand new I know better than that.)
