I live in indianapolis, IN. and I was just involed in an accident. Now I dont have insurence it just lapsed, but the other driver that rear ended me does have insurence. Am I at fault and does his insurence copmany have to pay for my car?

The other driver's liability insurance should just compensate for your loss. You haven't shared enough about the accident. So, it's hard to guess the party at-fault.

It is generally assumed that a rear end collision is the fault of the following driver. It is not always the case. As an uninsured driver, you will probably not be able to sue for "pain and suffering" but your actual financial loss can be covered up to the policy limits of the other driver's policy.
