Hoping my insurance totals my car - anything I can do?

I was rear ended 2 weeks ago. Yet the guy who hit me won't return his insurance companies' phone calls, thus they won't claim liability and so now I am working with my insurance to take care of this. I have new car replacement coverage as my car is just a year old, 8k miles is all. the body shop's initial repair estimate came out to $8500 - a little over half of the value of my car at $16,300 per kbb. I'm told they will go up to 65-70% of value to repair the car. I'm wondering as I've paid for the replacement insurance if they consider the cost of my car new in that estimate as reason to fix rather than total my car?

I really, really hope they total it as it has frame damage now and even if repaired will never have the same value. And while i'm not technically upside down with the lien, if they repair it and i'm forced to trade in a car that's been in an accident as I don't feel right selling it private party anymore, I may not break even with trade in values so low.

I'm in a rental car, as mine does not drive. I'm paying $2 out of pocket daily as my insurance only pays a fixed amount for a rental. which in theory they will go after the other guy or his insurance for. the bodyshop also believes it will take a full month to repair my car once they get authorization, meanwhile my insurance only pays for 30 days of rental car coverage.

They did a tear down of my car, and I am still waiting for my insurance adjusters estimate to come in, and whatever supplements they estimate?

Is there anything I can do to encourage them to total it out?

As you mentioned that the repair costs might go up to 70% of your car value, in that case your car Might be automatically deemed to be totaled by your insurer.

I don’t think you can influence your insurer to total your car. It all depends on the total repair costs. You'll have to wait for the final estimates.

If the accident was due to the other driver’s fault then his insurance should be paying to cover your loss. Since, you are going ahead with your own insurance I think they’ll subrogate in this case, so you’ll get paid anyway.

Remember that you do have the right to obtain another estimate. If your estimate exceeds their estimate you might be able to negotiate.
