My home was damaged by a hailstorm in 2006. Somehow the agency had cancelled my policy. The agent said he would repair my home himself because he didn't want to claim it on his E&O insurance. He sent several people to my home to give him estimates. One of them was going to patch the siding on my then 4-year-old home. I told the agent on the phone that I wanted my home repaired by the co. I had chosen so I would have a warranty. He assured me he would repair it just like the ins. co. would have. I told him no, it had to be done through the co. I had chosen. He said he didn't have that much money (about $12k) and that his wife was very upset. I have a letter he sent stating that he had estimates and wanted to get together to discuss the repairs.

I waited to hear from him again because I thought, or I guess hoped, he was gathering the money to pay to repair my home through the co. I had chosen.

I have since contacted the state dept. of ins., and the attorney general is in the process of revoking or suspending his license because of this. Now I find that I need to sue him for the cost of the repairs. Only now I am told that it is too late. I will have to give my home back to the bank and lose all the money I have invested in it. Our family will no longer have a home. I don't have the money to repair it on my own. I can't ever sell it like this. The roof and siding need to be replaced.

I know it is my fault that I waited so long. I realize that is stupid. I need to know if there is anything I can do. would appreciate any helpful advice.

I really sympathize with your situation.
I don't want to tell you about what you have already realized and paying a great price for it.

I am not an expert and can only think about telling you to consult your lien holder. Try to talk to the bank to modify your loan in a suitable way, so that you can stay current on your loan and get to keep your home.

In the mean time you may try to improve your financial condition by managing your budget and try to repair your home and get a suitable home insurance as soon as possible.

It is indeed sad. Try to find out if you still can sue the agent for his fraudulent behavior, if of course, you can afford it.
