Our 17 year old son was killed in an auto accident nearly 1 month ago.

He was driving his girlfriend's car with her permission. She was badly injured. According to the accident report he was at fault and he was driving to fast.

Our insurance claims adjuster says there was no insurance on our policy to pay anything to us but they will pay to the girl, which I think is great but we are left with nothing.

No compensation can fulfill our loss but the funeral expenses have caused us a lot of financial problems. Can we get anything from insurance without suing the girl as I don’t want to sue her?

I’m very sorry for your loss. I think you can seek coverage under your own auto policy. If your son was living at home with you, it’s very likely that he was defined as an insured under your own policy. The Personal injury protection or Medical payment portion of your policy usually extends coverage to any enlisted driver in the policy, if they are in a vehicle accident, and there is insufficient insurance to cover them because of bodily injury or death.
