I will keep this simple and if more info. is needed, please say so.
I am a bus driver involved in an auto accdient while working. The other party involved in the accident admitted his guilt in the accident. My employers carrier and the other partys carrier went through in-house litigation to see who will pay for the damages. My employers carrier had to pay for the damages.
I was charged (notice I said charged, and NOT convicted) of reckless endangerment. I had to pay a fine along with community service and found not-guilty. The court notified me that there was an outstanding bill for damages to a utility pole. My lawyer submitted confirmation that this property claim was paid by my employers insurance carrier.
What are the chances that my employers carrier will try to "recoup" the money from me? In what situations can this occur?

Some how I doubt that was the case. People who are found not guilt don't do community service and/or pay fines. What are the chances that my employers carrier will try to "recoup" the money from me?
0%. You are an insured under the policy. That is, the policy is paying to protect _you_ (as well as your employer). This is why they have insurance. A carrier can't pay on behalf of an insured per the terms of the policy and then collect from an insured. If that were the case, the insurance policy would be doing nothing. What are the chances that my employers carrier will try to "recoup" the money from me?
Again, 0%.Posted: Fri Nov 25, 2011 03:23 am Post Subject:

I guess if you paid a fine and did community service that your guilty verdict could be converted to something else. But in the mean time....

My lawyer made a deal with the DA that my charges would be just that, charges, and not considered a "conviction" if I paid a fine and did community service. This also means no criminal record after I am finished and complete everything. Part of the deal was also that the damages to the pole be paid. They did not care who paid it, as long as it was paid and it was (by the carrier).
Thats why I was asking if the carrier could come after me to try to "recoup" that money paid out.

Tcope has already said that the role of insurance policy is to protect it's insured by taking care of the liability charges. And it the carrier has already paid for the pole damages, it's very unlikely that the money would be recovered from you.
