What else Can I do ?

Hi my name is Anthony and my wife and 2 kids soon to be 3 have gone to hell with Amica insurance,,,,the ajuster Sahra H[deleted], AEGIS engineering services Inc, the engineer is James R[deleted] and the neighbors Brandon M[deleted] Jonathan J[deleted]..who live at [deletions by moderator MaxHerr]....All these people have lied to us and commited fraud . 16 months ago I was denied a claim that I put in to my neighbors insurance.company. the neighbors hosited up their house to repair cracks in their brick walls and their foundation . When they did the work the contractors dug out the earth from under the neighbors house to a retaining wall.they went at least five feet down and 6 feet wide they did this on the whole lenth of the wall which is at least 20 feet long. 2 or 3 years after that they put in a pvc drain system because their house still was cracking etc. a year after that they put in a tree fence 7 to 12 inches from the cement of the retaining wall and used a big drill auger to dig. then they cemented the post. This wall done inside the retaining wall from their house to the wall. then they took out a medium size tree about 10 or 12 feet from the retaining wall.... During this time they put in a pool that is half in the ground and half out. Then they put up another fence 3 feet from the tree fence.. They dug all the post the same way as the tree fence. So to recap they hoisted house,,,,put in drain system that was connected to their gutters from their house,,,,put in tree fence,,,,,took out tree,,,,put in a pool with decking and tall fence,,, then put in another tall fence. Oh yeah the contractor told them they had tp replace the retaining wall but they still chose not to.I now know why. The retaning wall is mine and my neighbors lied to me when they had a surrveyor come.I asked them and amica for a copy but was denied that also. Any ways the company hired the engiineer but I found out about 2 months ago the engineer does Not have a license in my State to give any expert opinion.Nor does the engineering firm.. I checked with my state....The insurance company and the engineering company knows what the laws are but they still chose to break the law. i have letters the insurance company and engineer sent us...these letters tell us that the engineer was retained by the insurance company to do a investagation...So we have proof. We live on a steep hill and my neighbor is the top house. They wont help stop anymore damage. they now on spite have their 3 downspouts facing my house...We have sinkholes,tunnels,water in main basement,MOLD,MOLD,MOLD Oh yeah did I mention MOLD..we have no heat because water keeps going in the boiler system. We had a pipe break because no hot water durning the winter. Now for over a year we get buckets of rain water and fill up our tub then when we have to go to the bathroom we use that water and throw it down the toilet so we can flush. We have two great little girls one is 4 the other is 8 and my wife is now with baby on board..... my kids use a walmart storge bin to take baths... The stress factor is threw the roof. i have lost 30 pounds since all this has happen.. I am the man of the house I am surposed to be able to fix this..4 years ago I started a small cleaning business but lost most of my income because I cant sleep and the way I do my job has suffered... I have talked to alot of lawyers but have found that people just dont want to take on this big insurance company..because they do business with them..i am gathering more evidence and i am going to the news. channel ..... called call for action . susan h[deleted] is the ladies name..what else can i do.

If you have talked to "alot of lawyers" and none of them want to represent you, it has nothing to do with any of them "do[ing] business with [the insurance company]". It has everything to do with you and your "case". Your rant above sounds like the ravings of a lunatic. You say that 16 months ago an insurance company denied your claim, but you don't even tell us what the claim was for. Insurance companies tend to deny claims that are not covered by insurance.

The fact that you wrote all of your diatribe in one paragraph, poorly punctuated, words misspelled, and proper nouns not capitalized . . . it all says to me, if nothing else, you are a very "disorganized" fellow. Much as we'd like to, we can't really help you with that.

Attorneys love to go after BIG INSURANCE COMPANIES because they have the money to pay judgments -- if there is a case to pursue. But those same attorneys don't want to represent incoherent, disorganized clients without genuine cases, because those folks don't make good clients or witnesses, and those folks often make it impossible for the attorney to properly litigate a case with actual potential for a positive outcome.

If you are having trouble with an insurance company over a claim, you can always turn to your state's (Rhode Island) Insurance Division, which is within the Dept of Business Regulation, for assistance -- as long as you are not represented by an attorney. http://www.dbr.state.ri.us/divisions/insurance/consumers.php

When you write to them, try to organize your thoughts, use complete sentences and paragraphs, and don't give them all the details of your family life and your weight loss or your sleepless nights. They can't help you with those things. The buckets of rainwater in the bathtub to flush the toilet with . . . maybe the health dept would like to know about that.

And you can always sue in small claims court for limited damages.
