I was in an accident about 6 months ago and I was the driver at fault for the accident. I had a couple of claims in that year and I was scared that if I file this one, my rates are going to hit the roof. I decided to pay for the damages out of pocket using my credit card and we signed waivers stating there would be no further liability for either the vehicle or injury. At that time I had no idea that there was a passenger in the other car. Now 6 months later I get a call from a claims agent from an insurance company and he tells me that the passenger from the vehicle went to a doctor and claimed injuries. She had Medicaid and now they are looking to be reimbursed. What can I do now? Can I file it with my insurance company? Will they pay for the Medicaid reimbursement and the money I paid out of pocket for the vehicle repair?

You are cutting it close and you need to file a claim IMMIDIATELY. There is a time window for filing claims and the closer it gets to the end of that period, the lesser are your chances of having your claim honored. The adjuster will have a tough time assessing the claim and there is a chance that the insurance company might deny it.
They might reimburse you for the money you paid out of your pocket to cover the repair charges. It might not be the same amount that you had paid. Hopefully you have pictures of the damaged portions of the vehicle and the repair shop bills. If not, the body shop might have them.
The medical bills will be covered if your policy had enough provisions to do so. File the claim as fast as you can, give an honest account of what happened and ask if you be reimbursed for your out-of-pocket expenses.
