Water damage. Can I claim replacement?

My car was stolen a couple of weeks ago and I had immediately filed a police report and a claim with my insurance company. On Thursday, the cops called and said that they had found my car. The windows and the windshield had been smashed, there is a crater on the hood and about a foot of water inside the car. There was water everywhere, even in the glove box. My insurance company wants to have the car fixed whereas I think it’s a irreparable wreck. Can I ask them for a replacement? Repairing it would be a waste of my time and their money.

Its up to the insurance company’s adjuster to deem a vehicle a total loss or not. You can do a couple of things for the time being. Let the insurance company have the car repaired and in case your policy covers ‘Loss of Use’, you can ask to be reimbursed for a rental car that you would need while your car is undergoing repair work. After the repair work is done, you need to inspect the car and find out if it has been resorted to its pre-loss condition. Don’t sign the release papers if you are not satisfied with the repairs. Tell them what you think is still wrong with the car and they should take care of it.

Yes, you can ask them to do anything you want. At the end of the day it's the agreement in your policy and state law that matters.

Yes, you can ask them to total your car. Tell them you suspect additional damage which will turn up in the repair process, and if they repair it, you will keep disputing the claim until you are certain the car is returned to its pre-loss condition.
