A few days ago I got out of office and went into the parking lot to get my car. While getting in I noticed that someone had put a dent on the side, nothing big but damage nonetheless. I wasn’t even in the car when it happened. I got the other guy’s insurance information and everything. If I take the check from the insurance company, am I obligated to have the damaged repaired? The damage is really minor and the check is for $290.

You do not need to have the car repaired. You can pocket the money.

Like tcope says, you can pocket the money without having to worry about any legal ramifications. Consider the fact that if you ever get into another accident, you won’t be able to claim full value for the repairs since you will have pre-existing damage to the car.
