sueing for lost wages

My husband was in an accident a week ago with someone who didnt have insurance. The other person was at fault. She hit my husband head on. My husband had only minor injurys, we think. But, his semi was totaled. that semi was our livelihood and we had no payment on it. Now we have to go buy another truck and will have added payments. We are only getting back $14,000 back for the semi. Thats what our insurance says our truck was worth. It was worth a whole lot more to us because it had a brand new motor in it and it was paid for. He was making almost $11,000/month. We have one daughter in college and my son will be going to college in the fall. Now as I said we will have to buy anew truck and have another payment because of this accident. The person that owned the vehicle was not in the car, she allowed someone else to drive the car. Apparently, neither person had insurance. But, Geigo was the company that allowed the owner to buy a tag for that vehicle. if it had no tag then maybe it wouldnt of been allowed on the road to hit my husband and we wouldnt have to be looking to buy a new truck and have lost wages?!! Am I right or not? I just want to know if Geigo should be somewhat responsable...

Nope... the STATE allows the person to buy a tag and the DMV is in control of this.

You are not.

a person can get insurance, get a tag and then cancel the insurance. The insurance company reports this info to the state and the state takes months and months to notify the person about the lapse and then perhaps they will eventually void the tag. However, the person still has the tag on their vehicle. If a police office runs it, they will see that it's not valid. That is a whole lot of time and a whole lot of if's.

If you are not being paid the correct value for your truck then you need to look into this. If you installed a re- manufactured engine then this does not really add any value... it maintains the value. it might add a little. If the truck is worth $14,000 and they pay you $14,000 then you can go out and buy the same truck for $14,000. No out of pocket expenses.

In some states, insurance companies report the lapse or cancellation of a policy to the DMV which then notifies the cops. The cops show up at the person’s house and demands that you hand over the license plates of the car to them. As for suing the at-fault party, you can take them to small claims court if you want to. The attorney is going to charge 40% of the settlement money plus his fees.

The OP is collecting from their insurance company so their insurance company takes over the right to collect. Most attorneys won't take PD claims like they will BI claims.
