Bad Situation

My daughter has a clean driver record. She recently married to a man who did not have a driver license. She made him get insurance and she transferred to his coverage. He totally destroyed her car last year in a one car crash. She assumed the driving privilages of one of his cars. He has his own. Both vehicles are in his name only. He has let his insurance lapse due to not getting his statement as a high risk driver from the state (Alabama) and not being able to afford the primiums. Today he has taken out insurance with the same company in her name and has added her to the bank account for the automatic draft. Alabama has passed a law that you must have a license to purchase auto insurance and he cannot get coverage in his name. Also, he should not be driving at all. She does not own either of these vehicles nor does she hold any of the title. Will she be responsible for him driving without his license because he cannot get them back until he has a probation period as I understand it. He is quite the con- artist when it comes to women. What is she to do? There is an infant involved in this marriage and it is going south.

I'm not even to the end of this post yet and they only thing that continues to jump out time and time again is that this person does not have a drivers license but he somehow gets insurance. This just does not happen. No insurance company is going to write a policy for someone 1) who can't legally drive and 2) on someone who can't be rated.

What is she to do?

I was thinking... pick a better class of man to marry... and then I read this:

Not trying to insult anyone but... saw this coming.

First, she's over 18 years old and she is living her own life. You are no longer responsible for what she does and she needs to make her own mistakes and live with them. You can give her advise but it's up to her as to what she does with it. What I _can_ say is that she's dug herself into a deep whole and it's only getting deeper. I have no doubt that he's driving without a license and she is on the hook for whatever harm he causes. He _WILL_ do something that will come back to her and she will end up even deeper then she is now. She's liable for _everything_ he's doing. She really needs to cut her losses and get out of the relationship. But again, you can only give her advise.

This is really not an insurance related question... it's a life related question.

You must not be able to answer legal questions abut insurance laws or maybe you would write this ppolicy just as the other agent is doing just to get the business. It would not come back on them, just my daughter. I just did not want you to ask "how did she get in this situation"? No help here. I'm sure I'll get lots of e-mails for insurance, but don't bother, we've had insurance with State Farm for 43 years. I raised good kids who make mistakes and I hope she doesn't end up like the past three or his mules. One dead, 2 felons for smugglings steriods for his gym to train MMA fighters and firefighters, policeman, and we all know every other walk of life. She did not live this life or grow up in it and she is dumb to it. He is a giglio and a con-man. Yes, she is realizing it, but she thinks he hung the moon and that nothing bad is going on. Life S- sometimes doesn't it and I have a pricioius little grandaughter that looks exactly like the one in the picture on the Salt lake comment. How odd; that is my concern. Yes my daughter is grown, but would society not be better if parents were envolved more with grown children. I know at 18 you shouldn't just mess up to learn life lessons. That is exactly what this husband's parents do and he continues to break laws and because his parents are isrich and big in their small community he is protected. She and her husband just turn their heads and all over town people talk about how her 3 sons do no wrong.

Agents don't underwrite policies... insurance companies do. I can promise you this... an insurance company won't write a policy without knowing the persons drivers lic number as they have to run it in order to obtain a rate to charge. What rate would the charge if there should be 0% risk (as the husband can't legally drive)? Let alone why would an insurance company help someone drive if they can't legally drive to start with? Its just not going to happen. I suspect what is really happening is that the policy only lists your daughter even though the husband is driving. If either of them are in an accident and this is found out, the insurance company can then recind the policy (cancel as never inforce) and not provide coverage. Your daughter is then on the hook for all the damage and all of the injuries. What is she going to do then?

What can be done? My point is that you can do very little and you need to accept that fact. I get the impression you ask as you feel somewhat responsible for your daughter. That is understandable. But you also need to understand that she is in control of her own life. You can only advise.

I've seen this hundreds of times. The husband does not have a lic for a reason. He ignores that and drives which again shows who he is. These type of people _will_ get into an accident. Your daughter will then be on the hook for that. I doubt that she can physically stop him from using the vehicle and they are married. You can only keep letting her know that people don't live like that and that she needs to cut her loses.

I'm not sure what else you are looking for.

She can have insurance all day, even she does not own the cars. The thing she has to do is take him off of the insurance. He gets an SR22 from the state Which He Has KNown For 3 Years, then they put him on the insurance as finanlcially responsible, but cannot drive. If he does she is liable , So she will be warned. After the probation period he can get his license back and then get a better insurance rate and get his license. He even has to take the test over. He will never do this and I know this is going to end badly. Maybe his rich parents will take on the responsibility since they have his health insurance and pay it for him at 37 yrs. old. They would not allow my daughter to be on it even if she paid so she now has the responsibility with her new job and they do not want to cancel him with their old so he can have double coverage. Won't happen with BCBS in Alabama. This is what we are dealing with. And you think I can only can advise when these people are affecting our daughters life. We will have a" come to Jesus" meeting Sunday after they get out of their Church. That is, if they will face us. They are completely in this together.

By "liable" you should understand that means she is uninsured when he drives the vehicle(s) without a driver license or as long as he is listed as an excluded driver (whichever comes last). Until then, your daughter will be 100% financially responsible for his actions, not an insurance company. At minimum wage, how long would it take her to pay off a $1,000,000 wrongful death award?

As for persons obtaining auto insurance without a driver license, it actually does happen. How, I don't entirely know, but we have several million unlicensed drivers in California, mostly illegal immigrants from Mexico, China, and Central America, and some of them have auto insurance. Must be coming from nonadmitted insurers, which is a different problem. Since it is unlawful for nonadmitted insurers to solicit business in the state (unless on the state's list of approved companies), I have no idea how persons would get connected to them other than through word of mouth.

It's a politically-charged issue here in CA, and current state law requires law enforcement officers to impound the uninsured vehicle of an unlicensed driver for a minimum of 30 days. The City of Los Angeles, beholden to its liberal labor unions, wants the Police Dept to look the other way, or at least allow a licensed driver with insurance to come get the vehicle instead of impounding it.

At the same time, the immigrant rights groups are clamoring for driver licenses for illegal immigrants so they won't lose their cars, so they can get insurance, and be able to drive to work -- to the jobs they are not supposed to have without the ability to prove their legitimate right to work. I'm just saying . . .
