Homeowners insurance fire claim unseattled

I have a big problem, june 2009 my family homestead which i was named beneficary when my brother past on sustained a fire. The insurance policy was in his name at this time. tne agency that represtented the insurance company was not helpful at all thru this whole matter and we have carried insurance with this agency over 59 years on this home. The insurance company lawyer contacted me and suggested that it be placed in an estate due to other family factors so i did this an was appointed administrator over the estate. Now my attorney sent in contents claim and medical bills only to be denied wanting to know how we figured the age and cost of items claimed and totally denied the medical in which came forth due to myself being in the house at time of fire. The insurance paid what was market value at that time the bottom had just fell on the market so was very low value but was told to get estimates on damages the policy was a very good one . It was a replacement policy but due to the workmanship on this historic home it was changed from replacement to a cash policy. Now thru addedums to the policiy the company has made it a replacement policy which required me to make all repairs and the company would reimburst when done. Now why would i carry insurance if I had the funds to repair the home. Ive asked from day one to meet with the adjustor but still after 2yrs have not had a meetng . My lawyer quit on my case and would not accept any offers that were proposed. I have contacted them since and no one will answer my request. My home is ruint and costing me money i dont have and cant close the estate till claim is closed this is not fair. Ive lost my family home my parents wanted us to have all due to the uncaring insurance company ;; Has to much time went by for me to do any thing with this claim? :cry:

If you are an insured under the policy, this denial is correct. It's not health insurance... it's liability (to others) insurance.

Because that is how the policy (and every replacement cost policy) reads. No shell game... it's spelled out in the policy. Insurance is not designed to make people a profit on a loss. So it's not going to pay to replace items... that have not been replaced. You take the ACV money and have some repairs done. You then collect RCV on that. Rinse and repeat. Also, most contractors will make repairs and then request full payment. So you have the repairs done, get the additional money from the insurance company and pay the contractor.

If you don't get a response you move up the ladder at the company. Do this every 24 hours you don't get a response. When someone tells me that they can't reach anyone at a company I have to doubt this statement. If you don't get a response in a few days, file a complaint with your states Dept of Ins. You should then have a response in a week or so.

"Insurance company lawyers" don't give this kind of advice to insureds. Mostly because it's incorrect.

The property, if owned by the OP's brother was already in his estate at the moment he died. There are so many other problems with this post, it's not even funny.

Loss Adjusters are hired by insurance companies so their loyalty lies with them only. A policy holder should not expect the loss adjuster to be impartial. They have been hired by the insurance company to negotiate with you and settle for an amount which is less than what you claimed for.

If this were true, adjusters and insurance company executives would be behind bars. This is a crime.

This is a really weird way of presenting the facts. I find it hard to believe that no reasonable explanation has been given to you in 2 years. I’m no expert in law, just a plain citizen but I know that if the [Link removed as per TOU] I recently bought was being unfair, I’d get to the bottom of things, coolly and calmly.

most of the times it happens that insurance company deny to give the claim and send its representative for minimizing the claiming amount but do not be get upset if you are suffering from such problems . hire a good loss assessor and put all the worries on his shoulders he will manage the best possible claim settlement for you.
