Theft/stripped

Hi I have a question I let my sister take over payment on my truck due to the fact that I was working out of town and needed a car so as she took over payments my truck was robbed and later found stripped at this point the insurance has said my truck will be total loss due to damage cost is there any way to get my truck back like say them give me the most they can to get it fixed because I'm back at home and I want my truck back

Did the vehicle have comprehensive coverage? If it did, it will be covered by your insurance policy.

Heller did not answer your question. You may negotiate with the insurance company to purchase the vehicle for its salvage value. The salvage value will be deducted from the claim value, and you will receive the difference. It may or may not be enough to complete the repairs.

The insurance said that they are not gonna let us purchase the vehicle back due to the theft and that we don't have the option to is there anyway I can get my truck back along with some money to get it back on the road I'm losing out a lot on the truck it's a 2008 with only 20000 miles it's still a new truck

Then your insurance company is incorrect. It's your property and they cannot take it from you by force. As such, what are they now going to pay you? According to their policy they _will_ pay for the loss so they cannot withhold that. The amount they owe is what they would pay less the vehicle's salvage value.

You are not "buying it back"... you are keeping the vehicle. It's always been your truck. You don't buy back what you already own.

Speak to a supervisor if the adjuster does not understand this.

Right I agree it's my vehicle my sister just took over payments but it's under my name and I want it back I went to go look at it they stole a nice system and DVD player from the inside alone with nice rims the bed was gone and the hood from the looks of it all the rest was still there I want to settle to get it fixed but the are pretty firm on total lossing the vehicle is there any way to get them to pay out enough to get it fixed even if I have to pay out of pocket

In reading your last post I over looked something... there is a lien on the vehicle. The only way your lien holder will probably let you keep the vehicle is if the amount paid by the insurance company, less the salvage is going to pay off the vehicle. Your lien holder is not going to allow you to keep the salvage if the loan is not paid off.

No way to make the insurance company pay more then the value. That is all that they owe.

One thing I would _not_ do... indicate to your insurance company that you needed your sister to take over the payments. This would be a _HUGE_ red flag for fraud.

Lets see.. you could not afford the vehicle... it gets stolen and not you want your insurance company to pay more then it's worth. That is about the biggest red flag possible.
