Where to sue a car ins co

i was involved in an automobile accident in New York State. The other drivers ins company has its main office in Georgia but the office that denied me my damages is in the state of Pennsylvania. Can I sue the ins. co. in NY where the accident occurred or do I have to go to Pennsylvania. If the answer is Pennsylvania does it have to be in the area where the office is.

Did the insurance company hit your car? You don't sue them in any of those states as they are not direct action states. You'd file suit against the person that hit you in NY. Unless you intend on collecting in small claims court you'd need to have an attorney (you'd most likely loose pro se).
