Sue the driver or owner?

I was rear ended by a tractor trailer in New York. My claim was denied due to a witness who I suspect was another truck driver who said I stopped short. It was literally stop and go for over 10 miles approaching the Tappan Zee Bridge.
My question is due I sue the owner of the vehicle or the driver in small claims court.

Depends on the state but there is nothing wrong with filing suit against the owner and the driver. If the one is not allowed, the judge would simply dismiss that portion. Its called, "bringing everyone to the table". It's does not affect you adversely to name anyone and everyone. You are going to be there any why. No sense in not "inviting" everyone.
