A person hit our daughter's car and claims that her lights should have been on to avoid the accident. They are claiming our car is a total loss at $1640 and are willing to accept 80% liability. Payout would be $1312. Of course, we also have to give up the car, which we don't get enough to replace with another one. If we pay our insurance the $500 deductible, can we get it fixed and keep the car? I'd expect our insurance to get some money from the other insurance.

So let me see if I get this straight... they are only paying you for 80% of your loss but collecting 100% of the value on your salvage. Sorry... that adjuster is just not thinking. They have no right to take and keep 100% of the salvage. The insurance company should either pay you your 20% of the salvage or allow you to keep the vehicle and deduct 80% of the salvage value from their offer.

So now I'm confused on who you are filing the claim with... your carrier or the other person's carrier. How can we know if you can keep the car or not as 10 we don't know who you are filing with and 2) we don't know if your carrier is stating its a total loss or not.
I'm not sure why your are blending those two situations together. They have nothing to do with each other.

This is the source of all confusion. Who is "they"?

When you own a vehicle, your insurance (or the other party's insurance) does not exist to make sure you get a replacement. It only promises to provide you with the ACTUAL CASH VALUE (replacement cost minus depreciation). When you drive an older car with high mileage, you should not expect much in the way of money from an insurance company when a total loss occurs.

You still don't mention if your insurance company would consider your vehicle a total loss or not. You don't "pay" your deductible... it's deducted by your insurance company from the amount owed. So it does not change the status of a vehicle being a total loss or not. The deductible has nothing to do with that.
