HOW LONG DOES AN EMPLOYER HAVE TO GIVE YOU TO MAKE YOUR DECI

by t.bramwellcmd » Thu May 10, 2012 11:02 pm

My husbands employer has decided to change insurance again. He just gave them the info today May 10, 2012 and wants an answer back by tom. Is this acceptable or is there a requirement of time that the employer has to give? I have been told at least a week by one person and our HR person says she is required to give us a month to make the decision. Please inform

This is unfortunate.

Your HR person is generally correct, unless this is an employer's self-funded plan, in which case ERISA says the Plan Document controls the situation. That document probably does not say "tomorrow" is how soon you must make an election. It probably gives you a significant amount of time, like 21-31 days.
