I am going out on short term disability before being laid of

I am being laid off work as of 5/31/12, I'm having back surgery on 5/29/12 and will be disabled for approximately 2 months. Will I be able to file for unemployment insurance benefits and receive in the state of California?

"An individual who files for UI benefits must be physically able to work, available for work, ready and willing to immediately accept work". So, you might not be considered eligible for the unemployment insurance benefits.

You can however find out details about California’s State Disability Insurance (SDI) program, to receive short term benefits.

Being disabled and unemployed are mutually exclusive situations. If you are unable to work as the result of your back surgery, you will be entitled to collect State Disability Insurance benefits. You apply for them through the Employee Development Department, the same as you would unemployment. The links above will provide you with the correct information.

Once your disability ends, you may then become eligible for Unemployment Insurance benefits.
