Auto-insurance

Recently my vehicle was insured with Nationwide. They sent us temporary proof of insurance and even faxed an experience letter to the DMV of my county to have the title transferred over to my name. The vehicle was added to my fiance's policy which apparently they are not allowed to do yet did it anyway. Somewhere along the line someone within nationwide reviewed the policy and red flagged it because the title was not in my fiance's name and they cancelled the insurance on it. We recieved no communication regarding the cancellation and the vehicle was involved in an accident. Nationwide is trying to say that the vehicle was never insured through them yet we have the paperwork including temporary insurance cards stating that the vehicle is indeed insured. They are denying the claim but I have been told by multiple individuals to take them to court. I am unsure of how to go about doing that or what grounds I have, monetary value to sue for and such. Some insight would be so helpful right now.

First, are listed on the Nationwide policy? I'm guessing not, otherwise I don't see the issue. If you are not, then you are trying to insure your vehicle, for which you drive, under someone else's policy.

The problem here is that I'm betting at some point someone misrepresented themselves... either with who owned the vehicle or who would be driving it. If so, then the insurance company can remove coverage from the vehicle.

Your fiance would have been informed of this, also your premium would have been reduced. I can't count the number of times when people "claim" to have first found out that they had no coverage only after an accident. Funny how that timing works out.

If you are going to file in small claims court you obtain the documentation from the court (online) complete it and follow the instructions. If you are going to file in a higher court then I recommend that you hire an attorney and discuss the matter with the attorney.

most of the times i have seen that the insurance companies are trying to escape from giving the claims. you should hire a loss assessor and re submit the claim..
