Car Crash

So a friend and I went to a party on friday night. The party went on till about 4 am, at which time everyone fell asleep. The friend and I had both been drinking. He took the keys of a friend of ours, a girl, who was sleeping at the time. He drove himself home and I drove the car back, but ended up crashing it, but still managed to drive it back to its original destination. She filed a police report, but I still haven't been contacted by anyone. It is now tuesday, and I have no idea if this 17 year old's parents are going to press charges for us taking the vehicle. If they press charges, what are my friend and I looking at? There's no proof that we were drinking, but I don't know what is going to happen. The whole situation is freaking me out and I don't know what to do.

How is this insurance? It's criminal. That is what you are looking at... car theft. My guess is if you were charged that you'd be charged with a lesser crime. But bottom line that is what you your friend did. I think being drunk is the least of your worries. You have criminal charges to worry about and the damage to the car to pay back.

Yes, it's criminal and you'll be held liable for the damages anyway.

Since the car has been driven without her (the owner's) permission, her insurance won't cover the damages. Your insurer will have to pay (assuming you have that). If you were uninsured or underinsured, her collision coverage will come into effect and pay for the repairs, but then they'll file subrogation against you.

If it's proved as a theft, and assuming that you have insurance, your insurer will simply not pay for a criminal act.

If the policy has collision coverage, that will address the damage to the vehicle. Also, liability _coverage_ will be extended to the policy holders. The exclusion you mentioned would only exclude liability coverage to the poster. But this really only serves to allow the carrier to seek recovery against the poster if they pay anything out on liability.

Apparently, there were two persons who did not fall asleep which resulted in a nightmare. Drunk people have no excuse for their behavior behind the wheel of a motor vehicle, and deserve to be prosecuted for it. Making plans for jail now will make that experience more pleasant.

Care to add "perjury" to your list of criminal charges? That one's a felony, and you won't go to jail, you will go to prison instead. You just admitted that much to the world here. Friday night's intoxication must not have worn off yet, or it permanently fried some of your brain cells.

In jail, you get to spend time with "Squeaky" and "Weasel" and "Chuy" and "Flacucho" -- persons who are locally famous in spray paint on walls around town. They're jerks. In prison, you get a new spouse named "Bubba" whose libido is unmatched. He will enjoy trying to make a baby with you every night for the next five years. Maybe he'll succeed, maybe he won't. But he'll enjoy every minute of it. You might not.
