pschyolocial/emotional pain and suffering

Hi,

If my child was injured badly in an accident with me as the driver (not at-fault).

Would I be able to get pain and suffering for pschyolocial/emotional pain i went through for this situation?

Depends on the state. Some states. But in most cases, you could make that _argument_. Expect the carrier to want documentation of some type to back up your claim. That is, _you_ need to prove that you suffered from emotional distress and that you were injured in some way.

It is your child who most likely would have suffered psychological or emotional distress/trauma. You, on the other hand, could have suffered "loss of love and affection" (for which you can be compensated) more than psychological damage if you were not physically injured. You would probably need an attorney to press that matter for you, in which case, you will have to give the attorney 30% to 40% of your settlement, and of your child's.
