My handicap van was stolen.

4 months ago my handicap van was stolen, it was recovered a couple of days later about a mile from my home. The side door is wide open and won't close and the lift is broken. My ins. co. investigated and is refusing to settle my claim, saying that the van could not have taken without the the key. I told them my keys were accountted for, but over 2 dozen different people had driven me around over the past two years giving them access to my keys now my insurance co. wants me to give a third statement to their lawyers. I am so angry and frustrated i havent been able to leave my house for four months my one year wedding anniversary came up and i had to rent a van so i could go to dinner with my wife and that cost over two hundred dollars . if i need to go to the doctor i pay a van service 70 dollars an hour to take me. can i sue my insurance co. for breach of contract?

Your company has a right to obtain an Examination Under Oath, which is what you are doing when you give a statement to the attorney. My recommendation is 1) that you send a certified letter to your carrier asking them to pay your claim w/in 30 days. You may also want to file a complaint with your states Dept. Of Insurance. Four months is awhile. I'd think if they wanted an EUO, they should have asked for it before now.

Can you sue? Certainly. You could have filed suit from day one. Filing suit does not mean you will prevail.
