hit and run on a longboard

I was hit by a car while long boarding across a legal crosswalk. I was thrown over the hood and she almost drove away. She barely provided any contact info, so the state of Utah might press charges. After 7 months of chiropractic treatment, the doc said I was as good as I'm going to get, and I will probably be in pain the rest of my life. I'm not trying to get rich but I do think I deserve fair compensation for the lifestyle that is now painful to lead. I used to long board an average of 6 miles a day going to and from work. Now my back hurts so much I might be able to board 0.25 miles 2 to 3 times a Week. I also have two kids but playing with them is now an activity that puts me down for the rest of the day. I believe the medical came to about $8000 after everything. What is a fair base request?

What is a fair base request?


One that you are willing to accept and the other carrier is willing to pay.

You should be either getting $3000 in PIP from a vehicle you own or the vehicle that hit you. If you've not paid the remaining medical bills, after you settle you can contact the medical providers and ask that the bills be reduced.

Hi Kenney, I'm really sorry to hear about the incident. My deepest sympathies are with you and your family on this loss.

Anyway, first let me clear some doubts that I'm having..

You said that she barely provided any contact info and now it has been more than 7 months. So how would you catch her? I don't think you know her.

Anyway, here I have to disagree to what tcope has said. Perhaps, it's MedPay and not PIP that is going to pay for the damages since only MedPay pays for injuries suffered if a car hits you.

Still, you have to keep in mind that now it is past 7 months but you have to file a claim a you get no other choice.

After the accident, I captured a partial licence plate with my phone. The police used that and other info to track her down. She was charged and eventually convicted, with several eye witnesses, to "hit and run". I have hired an attorney and exhausted my PIP.

UT does not have MP, it only has PIP and PIP applies, as you stated when a vehicle is involved. In this case the OP was hit by a vehicle. PIP applies to pedestrians that are struck by a vehicle.
