i got in a car accident in dec 2012 ,i rear ended some one on the fwy,
so my car is a 2011 gti, the insurance company told me it would take one month
and cost $7000.
we are now in may of 2013 and they have spend $26000 on repair and rental,
and now i am being told that they may need to spend another $6-7000 on the car,
they have given me the car back 3 or 4 times and i have returned it with in a week ,
for unacceptable work,
the car is worth $15000.
honestly at this point i dont even want the car back ,can i legaly ask for them to total
the car ???

Your insurance company will send an adjuster to calculate the total loss of your car. There is no need for you to ask for that. Its a standard process followed by the insurers before processing a claim or compensating for a damaged insured vehicle.
