Infinity auto insurance scam

2 Weeks ago, my partner and me got involved in a car accident. The other guy was drunk and hit our car (barely scratched it) but was so scared that he flee the place. The insurance says that it’s over 7k to repair for the damages. We followedhim that night, took pics and videos of the plot. He went to jail that night. We are both insured by eSurance but though it wise to use his insurance to cover for the repairs.

Today my lawyer who is also my father-in-law spoke to this insurance company (Infinity Auto Insurance) and they told him that the drunk guy’s car has barely any scratches. However, we are talking about a car that broke down as the complete front part was destroyed. Then they told him that the person was probably not insured. I decided to gather information about the company and that’s why I went online and wherever I visited, I heard the same story. The company makes up every possible excuse to say that they are not paying.

So here I want to know that who regulated these scam companies? I already checked with the BBB and of course they don’t recommend the carrier. But what can be done so they no longer scam people?

It is really frustrating. Anyone with similar experience?

First, _your_ company is only with that driver (unless you are in a direct action state... but even that won't change much). If they want to deny their insured coverage then that is between those two... you don't have any control over that. You can feel free to file a complaint with the Dept of Insurance (who regulates the insurance company) but this won't get you very far as it's a coverage issue that you have no part of.

If your claim is not being address how you'd like then you can feel free to file suit against the at fault party. If you obtain a judgement you still need to try to collect from that person.

Do you have collision or uninsured motorist property damage coverage? If so, file under your own policy and have your carrier take care of your loss and pursue the other party on their dime.

If you search the Internet under trillions of pages you are bound to find a few mentioning the same issue you are having. This will be true of _every_ insurance company.

The company is not scamming _you_... if they deny coverage to their insured then it has nothing to do with you.

When will people realize the Better Business Bureau is a scam?

First, insurance is a regulated business, so the BBB has nothing to do with how insurance companies or agents conduct their business. The state regulates insurance companies and has the ability to put a company out of business for shoddy claims handling practices, if that is the case.

Second, as was discovered here in Los Angeles in the past year, better BBB rankings are given to persons who pay to be a member. Turns out the BBB in LA gave A+ recommendations to, among others, terrorists on the federal watch list -- persons and businesses who "applied" for membership in the BBB, including if I'm not mistaken, Hamas itself. Actually, the applications were part of a sting operation to prove the fallacy of the BBB ratings.

Insurance companies have to rely on the integrity of their insureds, just as we must rely on the integrity of our insurance companies . . . it's called "utmost good faith". When an insured lies to the insurance company, they accept it as the truth until proven otherwise.

Finally, attorneys who have no experience handling insurance cases are a dime a dozen. They generally can't do more for you than you can do for yourself, even if they are related by blood or marriage.
