if a person is dui and wrecks will the ins company pay for damages

Assuming the person has collision insurance, the answer is yes. As for liability coverage for damages done to others, there could be language in the contract that can avoid coverage for losses due to "criminal acts committed by an insured" and since driving under the influence is a misdemeanor crime, that could allow the insurance company to avoid the claim.

I have a recording of my neighbors stating that his brother was dui on new years eve 2013 and wrecked. they picked him up had him shower; change cloths; and sobered him up then went back to crash . he was only sited for leaving .I don't know what they told their ins co. so he lied to police, and no doubt to the ins co. what should I do

If you believe insurance fraud may have occurred, you may report it to the local police department, to the district attorney, or to the state Dept of Insurance.
