I was driving down a gravel road and there was another vehicle stopped and pulled over i drove by and as i did this guy went to do a u turn i drove into a ditch to avoid him hitting me. he left scene however i was able to track him down and get his info and insurance. he admits to doing u turn and police report states he caused me to go into ditch. his insurance is in the process of deciding if they will pay. any opinions as to what will happen? Unfortunately my 2 week old brand new f150 is damaged and am very sad due to all these.

If the other party's insurance company denies your claim, you can always sue the other driver and hope the court/jury agrees that the person was negligent and responsible for your loss.

The sun will rise tomorrow. Other than that and I gave up predicting the future and reading minds.

I spoke with their adjuster yesterday and they denied the claim. I am turning it into my insurance now and having them fight the battle for me. Hopefully they can do more than i did.
