I live in Virginia...I was in accident last year in which resulted in knee surgery and complicated recovery totaling approx. $58,000 in lost wages and medical bills. My health insurance covered all claims up front. I recently settled with insurance with much less than desirable amount. My health insurance stated they will not be subrogating due to Virginia laws. How long is statute of limitations for my STD insurance to file a subrogation claim? Also can doctors offices legally ask for part of your claim? I had a office that had been paid in full by health insurance and copay but they state that since my medpay reimbursed me that I owe them this amount of money...if they are already paid? How can they request additional payment?

They cannot make such a demand unless there was a portion of the bill you are responsible for paying and have not paid.Report the physician to the State Insurance Commissioner, and the state Physician Licensing Board.
